°MEQU A/S, Fruebjergvej 3, 2100 Copenhagen, Denmark, CVR no. 33968698, and its affiliated subsidiaries and companies, including MEQU Warmer Systems Corp., 1501 Langston Boulevard, Suite 301, Arlington VA 22209 (referred to as “°MEQU”, “we”, “our” and/or “us”), is committed to protecting your personal data and processes your personal data pursuant to what is set forth in this Privacy Statement and in accordance with any applicable personal data protection laws.
This Privacy Statement describes the ways in which information about individual persons may be collected, used, disclosed, transferred, and stored by °MEQU.

1. Data controller
°MEQU is the data controller responsible for the collection and processing of your personal data.

2. How we collect and process your personal data
°MEQU may collect personal data from you in various situations, as outlined below. The data will typically be collected directly from you, but if we collect data from other sources this will be reflected below.
2.1: Marketing material, contact forms and newsletters
If you choose to subscribe via our contact form to receive marketing material or newsletters from °MEQU we will need to collect basic personal data such as name, e-mail address, telephone number, address, place of employment, the content of your message, e.g. product interests and/or any other preferences in terms of content. The purpose of collecting your personal data is to be able to distribute relevant marketing material to you via email and contact you regarding products of your interest.
Depending on your location and request, some data, including your contact information, may be shared with your local distributor for your local distributor to be able to contact you with relevant marketing material relating to your local market. The legal basis for °MEQU’s processing of your personal data for marketing purposes is consent (Article 6, para. 1, lit. a, of the General Data Protection Regulation, (EU) 2016/679), (“GDPR”).
2.2: Collaboration partners
When °MEQU engages with you as a contact person of a collaboration partner in relation to a collaboration regarding e.g. evaluation, testing and/or use of °MEQU products, °MEQU must collect certain personal data depending on the engagement, including name and contact details, the collaboration partner you work at and information relating to the collaboration.
The purpose of collecting personal data is to engage in collaborations with third parties and to be able to maintain and improve our products.
The legal basis for °MEQU’s processing of your personal data in relation to product collaboration is °MEQU’s legitimate interest in participating in product collaboration activities (Article 6, para. 1, lit. f, of the GDPR).
2.3: Traceability, reliability and safety requirements
°MEQU processes personal data relating to collaboration partners or health care professionals to meet traceability-, reliability and safety requirements regarding the medical device.
The purpose of the processing is to be able to locate previously sold products and contact customers to e.g. recall relevant products in case of defective product lines or a product that otherwise fails to meet applicable requirements.
The legal basis for °MEQU’s processing of your personal data in relation to product traceability is medical device compliance (Article 6, para. 1, lit. c of the GDPR) and the medical device regulation and the Danish Medical Device Act. In case the incidents reveal any special categories of data, e.g. in relation to patients or users of the device, the legal basis is Article 9, para. 2, lit. i.
2.4: Customer service & product fulfillment
°MEQU will need to collect certain contact information on our contacts to enable service fulfillment, such as delivering products and/or purchasing of services, conducting training events, handling any inquiries, complaints, questions or similar. The data we register concerns relevant contact persons at our collaboration partners and customers.
°MEQU will only collect the following basic personal data: name, title, email address, telephone number, place of employment, and the type of our collaboration as well as your relevant product area and product of interest.
The legal basis for °MEQU’s processing of your personal data regarding product fulfillment and customer service activities is °MEQU’s legitimate interest in providing you with appropriate assistance (Article 6, para. 1, lit. f, of the GDPR).
2.5: Job applications
If you submit a job application to °MEQU to apply for a job within °MEQU, °MEQU will process your personal data as part of the recruitment process.
The type of personal data we collect is your name, address, contact details, professional history, cover letter and CV.
Processing of your personal data in relation to recruitment is necessary to pursue our legitimate interests, including managing the recruitment process, evaluating applicants, and hiring the most suitable candidate (Article 6, para. 1, lit. f, of the GDPR).
If °MEQU finds it necessary to obtain statements from previous employers, including information about your job responsibilities and qualifications, to evaluate your experience from previous relevant positions, this will be done based on your prior consent, pursuant to Article 6, para. 1, lit. a, of the GDPR.
If °MEQU finds it necessary to obtain a criminal record from you, to evaluate your compatibility with the position you have applied for, this will be done pursuant to Section 8(3) of the Danish Data Protection Act.
If °MEQU offers you a position within the company, processing of your personal data is necessary to take steps at your request for our evaluation of your job application and CV prior to the potential execution of an employment contract (Article 6, para. 1, lit. b, of the GDPR).
Please refrain from providing us with information which is not relevant to the job that you are interested in or applying for. Also, please do not include sensitive information or national identification numbers in your job application, CV, or other relevant documents.
2.6: Cookies
We process personal data using cookies on our website. Provided you consent through our cookie consent wording, °MEQU may use cookies for marketing purposes, i.e. to personalize content and ads, to provide social media features and to analyze our traffic. We will also use cookies for preference settings and statistics.
Our legal basis for processing data is your consent, cf. the Executive Order on Cookies and GDPR Article 6, para. 1, lit. a. Personal data collected via necessary cookies relies on the balancing of interest rule, cf. Article 6, para. 1, lit. f, where the legitimate interest we pursue is to provide you with a website that works in an optimal way.

2.7: Processing of personal data for other purposes
Your personal data may only be processed for other purposes than stated above if necessary to comply with legal or regulatory obligations (e.g., transfer to courts or criminal prosecution authorities), cf. Article 6, para. 1, lit. c, or if the processing is otherwise lawful under applicable law or if you have provided consent to the respective processing, cf. Article 6, para. 1, lit. a. If processing for any other purposes should take place, we may provide you with additional information.
3. Recipients of personal data
3.1: Data processors
Your personal data may be disclosed to external suppliers, such as IT service providers, who deliver services on behalf of °MEQU. For example, in relation to distribution of newsletters and/or marketing material, invitations to events, product information etc.
°MEQU has entered into data processing agreements with external suppliers who are acting as processors on behalf of °MEQU (see below regarding any transfers outside the EU/EEA).
3.2: Distributors
Some data relating to your purchase of °MEQU products, including your contact information and which products you have purchased or shown interest in, may be shared with your local distributor. The list of °MEQU distributors can be found on following link: List of °MEQU distributors.
The legal basis for the disclosure of your personal data to your local distributors for marketing purposes is consent (Article 6, para. 1, lit. a, of the GDPR).
3.3: Mergers & Acquisitions
In the case of a re-organization, full or partial sale of °MEQU, any disclosure in such connection will be in accordance with current legislation for the processing of personal data.
The disclosure of your personal data to third parties in the event of a re-organization, full or partial sale of °MEQU, is necessary to fulfill and protect the legitimate interest of °MEQU (Article 6, para. 1, lit. f, of the GDPR) in disclosing information, e.g. customer information, in relation to a possible sales process.
3.4: Social media
When we collect and use cookies, we will also share information about your use of our site with our social media, advertising and analytics partners who may combine it with other information that you’ve provided to them or that they’ve collected from your use of their services.
You can see the specific third parties in our cookie policy. In some cases, we may act as joint data controllers with these providers, and we always recommend you review the privacy policy of these providers.
You can always contact us if you have any questions regarding the processing of personal data in this regard. The legal transfer basis will be consent (Article 6, para. 1, lit. a, of the GDPR).
3.5: Other disclosure
Other third parties may need to access or store personal data if required or permitted by applicable law (e.g., governmental authorities, courts, external advisers and similar third parties that are public bodies). In such cases, the data will be processed based on Article 6, para. 1, lit. c.
4. Transfers outside the EU/EEA
Your personal data may in some situations be transferred to countries outside the EU/EEA.
This may be the case if we use data processors outside the EU or in situations where you have contacted us to receive marketing material. In such cases we may distribute your data to our local distributors (see their locations here). °MEQU may also in some instances transfer data to our subsidiary in the USA.
°MEQU ensures that any third country transfer will be carried out in accordance with the applicable data protection laws, which include that °MEQU will ensure only to transfer your personal data outside the EU/EEA when an adequate level of protection can be ensured. °MEQU has in place EU’s standard contractual clauses and for the US may rely on the EU-US Data Privacy Framework, as applicable, to ensure sufficient safeguards with respect to the protection of the privacy and fundamental rights and freedoms. In limited circumstances other legal transfer mechanisms can be applied and always contact us if you wish to obtain information regarding the transfer mechanism relied upon.
In addition, supplementary measures are established, where applicable, to ensure sufficient protection of your personal data.
5. Deletion of your personal data
°MEQU will delete your personal data when it is no longer necessary for the purpose(s) for which it was collected.
Retention periods are determined based on the nature of the data, the purpose of processing, and applicable legal requirements. When personal data is no longer required, we ensure that it is securely deleted, anonymized, or otherwise disposed of in accordance with applicable data protection laws.
For instance, personal data relating to job applicants who are not offered a position will be deleted after 180 days, while personal data processed based on consent for marketing purposes will be deleted when the consent has been withdrawn. In certain cases, data may be retained for a longer period if necessary to establish, exercise, or defend legal claims or if required by relevant legislation.
6. Links to other websites etc.
°MEQU’s website may contain links to other websites or to integrated sites. We are not responsible for the contents of the websites of other companies or for the practices of such companies regarding the collection of personal data. When you visit other websites, you should read the owners’ privacy policies on the protection of personal data and other relevant policies.
7. Your rights and how you can access your personal data
Under applicable data protection legislation, you have various rights as a data subject as listed below (subject to the conditions set out in applicable law).
- Access your personal data.
- Rectify inaccurate or incomplete data.
- Erase your data (“right to be forgotten”).
- Restrict or object to processing.
- Data portability where applicable.
- Withdraw consent at any time and providing your consent is always voluntary. Such withdrawal will not affect the lawfulness of the processing based on consent before its withdrawal.

8. Filing of complaints
You always have the right to file a complaint to the applicable local Data Privacy Authority within your country/jurisdiction, in Denmark, the Data Privacy Authority in the EU overview.
